This privacy policy aims to provide all the information regarding the processing of personal data carried out by Crono SaaS Ltd when the user browses the website (as better specified below).
The Controller takes the utmost account of its Users’ right to privacy and protection of personal data. For any information related to this privacy policy, Users may contact the Controller at any time, using the following methods:
By navigating the Website, the User can register to the Website to take advantage of the services offered by the Controller (hereinafter, the “Service”). In connection with the activities that may be carried out through the Website, the Controller collects personal data relating to the Users.
The Website and any services offered through the Website are reserved for individuals who are 18 years and over. Therefore, the Controller does not collect personal data relating to individuals under 18 years of age. Upon request of the Users, the Controller will promptly delete all personal data that has been involuntarily collected and related to subjects under the age of 18.
The personal data of the Users will be processed lawfully by the Controller for the following processing purposes:
a) Contractual obligations and provision of the Service: to enable navigation of the Website or to give effect to the Terms and Conditions of the Website, which are accepted by the User when registering on the Website; fulfill specific User requests. User data collected by the Controller for the purpose of any registration on the Website include: First Name, Last Name, Company Name, Business Email Address and Phone number, as well as any personal information of the User that is eventually and voluntarily posted. Unless the User gives the Controller a specific and optional consent to the processing of his/her data for the further purposes provided for in the following paragraphs, the User’s personal data will be used by the Controller for the sole purpose of ascertaining the User’s identity (including through validation of the e-mail address), thus avoiding possible fraud or abuse, and contacting the User for service reasons only (e.g., sending notifications regarding the services offered on the Website). Notwithstanding the provisions elsewhere in this privacy policy, under no circumstances will the Controller make Users’ personal data accessible to other Users and/or third parties;
b) administrative-accounting purposes: to carry out activities of an organizational, administrative, financial and accounting nature, such as internal organizational activities and activities functional to the fulfilment of contractual and pre-contractual obligations;
c) legal obligations, or to fulfil obligations provided by the law, an authority, a regulation or European legislation.
The provision of personal data for the processing purposes indicated above is optional but necessary, since failure to provide such data will make it impossible for the User to access the Website and to use the Service.
Personal data that are necessary for the pursuit of the processing purposes described in this paragraph 3 are indicated with an asterisk within the request form.
To Users who have purchased its services, the Controller may send, without requesting their consent, commercial communications, exclusively (i) by e-mail and (ii) relating to services similar to those already purchased, i.e. belonging to the same product category.
It will be possible to object at any time, easily and free of charge, to further sending of such communications by means of the automated unsubscribe links present in the Controller’s communications, as well as by the ordinary means indicated in paragraph 8 below (in this case, this processing purpose will be pursued by the Controller, without the need to acquire the User’s consent, in line with the exemption provided for in Article 130, paragraph 4, of the Italian Legislative Decree No. 196/2003, without prejudice to the aforementioned possibility for the User to easily object).
some of the User’s personal data (i.e. first name, last name and e-mail address) may also be processed by the Controller for marketing purposes (sending of advertising material, direct sales and commercial communication), i.e. so that the Controller can contact the User by mail, e-mail, telephone (fixed and/or mobile, with automated call or call communication systems with and/or without the intervention of an operator) and/or SMS and/or MMS to propose to the User the purchase of products and/or services offered by the Controller itself and/or third party companies, present offers, promotions and commercial opportunities.
In case of non-consent, the possibility of registering to the Website will not be affected in any way.
In case of consent, the User may at any time revoke the same by making a request to the Controller in the manner set out in paragraph 8 below.
The User may also easily object to further sending of promotional communications via e-mail also by clicking on the appropriate link for revocation of consent, which is present in each promotional e-mail. Once the revocation of consent has been made, the Controller will send the User an e-mail message confirming that the consent has been revoked.
If the User wishes to revoke his/her consent to the sending of promotional communications via telephone, while continuing to receive promotional communications via e-mail, or vice versa, please send a request to the Controller in the manner set out in paragraph 8 below.
The Controller informs the User that, following the exercise of the right to object to the sending of promotional communications via e-mail, it is possible that, for technical and operational reasons (e.g. formation of contact lists already completed shortly before the receipt by the Controller of the request for objection) the User will continue to receive some additional promotional messages.
Should the User continue to receive promotional messages after 24 hours have elapsed since the exercise of the right to object, please report the problem to the Controller, using the contacts indicated in paragraph 8 below.
Contractual obligations and provision of the Service (as described in paragraph 3, letter a) above): the legal basis is Article 6, paragraph 1, letter b) of the Regulation, since the processing is necessary for the performance of a contract and/or the execution of pre-contractual measures taken at the request of the User.
Administrative-accounting purposes (as described by paragraph 3, letter b) above): the legal basis is Article 6, paragraph 1, letter b) of the Regulations, as the processing is necessary for the performance of a contract and/or the execution of pre-contractual measures taken at the request of the User.
Legal obligations (as described in paragraph 3, letter c) above): the legal basis is Article 6, paragraph 1, letter c) of the Regulation, since the processing is necessary for compliance with a legal obligation to which the Controller is subject.
Additional Processing Purposes: for the processing related to marketing and soft spam activities (as described by par. 4.1 and 4.2 above), the legal basis consists of art. 6, paragraph 1, letter a) of the Regulations, i.e. the provision by the data subject of consent to the processing of his/her personal data for one or more specific purposes. For this reason, the Controller asks the User for the provision of a specific consent, free and optional, in order to pursue this processing purpose (except in the case of the processing described in Section 4.1 above where, pursuant to Article 130, paragraph 4, of Italian Legislative Decree No. 196/2003, there is an exemption with respect to the obligation to request consent).
The Controller will process the personal data of Users using manual and IT tools, with logic strictly related to the purposes themselves and, in any case, in order to guarantee the security and confidentiality of the data.
The personal data of the Users will be retained for the time strictly necessary to carry out the main purposes explained in paragraph 3 above or, in any case, as necessary for the protection in civil law of the interests of both the Users and the Controller.
As for the processing referred to in paragraph 4 above, Users’ personal data will be retained for the time strictly necessary to fulfil the purposes illustrated therein and, in any case, until the User revokes his or her consent or exercises opt out, without prejudice, in any case, to any retention periods provided for by law or regulations.
The User’s personal data may be transferred outside the European Union and, in this case, the Controller will ensure that the transfer is carried out in accordance with the Applicable Law and, in particular, in accordance with Articles 45 (Transfer on the basis of an adequacy decision) and 46 (Transfer subject to appropriate safeguards) of the Regulation.
The employees and/or collaborators of the Controller who are in charge of carrying out Website maintenance may become aware of the personal data of the Users. These subjects, who have been instructed by the Controller accordingly to article 29 of the Regulation, will process the User’s data exclusively for the purposes indicated in this policy and in compliance with the provisions of the Applicable Law.
The personal data of the Users may also be disclosed to third parties who may process personal data on behalf of the Controller as “Data Processors”, such as, for example, IT and logistic service providers functional to the operation of the Website, outsourcing or cloud computing service providers, professionals and consultants.
Users have the right to obtain a list of any data processors appointed by the Controller, making a request to the Controller in the manner indicated in paragraph 7 below.
